What is the name of your state? California
My grandchildren live in Arizona with their mother and her boyfriend. He has been their father for the past two years. The biological father has had no
contact and paid no child support. Can the boyfriend be considered a stepparent and claim head of houshold and/or claim the EIC? He has provided much more than 50% of the support for this family.

He can claim HH if the kids lived with him all year in 2002. He cannot claim them for EIC unless they were placed in his home by an authorized placement agency. Only the mother can claim them for EIC. hopefully she had some earned income.
