Subject: Mom no will with bills

Mom just passed away. She has two credit card bills about $400.00 and hospital bill about $2500.00. Very little insurance just enough to bury her. Sister says we don't have to pay Mom's bills. I don't agree with her. Can we get in trouble if we don't pay. Worried in Illinois

My condolences about her death. If she had no assets (no clothes, no furniture, no bank accounts, no nothing) there is nothing to pay the bills with and you can, but don't have to pay them out of your assets. (If you had guaranteed to pay them, that would be different.) But if she had any assets and you take them or dispose of them, their value must be first used to pay the bills.
