I was named the executor of my aunt's estate, who passed away over a year ago. The estate has been settled; however, I recently received a check made out to the estate of my aunt for an over payment to a hospital where she had received treatment. I attempted to cash the check at the bank where I do business but they would not cash it. The only document I have that states I am the executor is her will, and that was unexceptable. The estate did not go through probate because all of her remaining assets were in joint ownership. Is there a way to cash the check without having to go through probate?

If you are legally authorized to cash the check then you cannot be committing a fraud if you endorse the check for deposit. You must make sure that you handle the funds according to the laws for administering small estates in your jurisdiction.
