No w-99's !!

What is the name of your state? Ohio,My wife,who is a Physician's Assistant works for a Doctor but withholds her own taxes.She is leaving her current job for another job and the doctor she works for knows this and is refusing to give her tax forms(W-99's?)We also think he will try and not pay her for the final hours she has worked until she leaves. What can we do?

The MD must issue a 1099-MISC to anyone to whom he pays more than $600 in a year. Failure to do so may cause the IRS to fine him. If he refuses to pay, she can sue him for breach of contract. Furthermore, since she's leaving anyway, she can file a form SS-8 asking the IRS to determine if she was really an employee & he should have been paying 1/2 the employment taxes the whole time. (She almost certainly was & he could face BIG fines.)
