My Mother is living in Florida and my sister has lived in the same house and paid most of the bills. When my Mother went to an attorney to do her will she was told not to worry that my sisters name isn't on the deed. That since there was a couple of years to pay off (3years) that it would effect the taxes. We want to avoid the problems with the state and probate. My sister needs to be on this for her protection of losing her home. What should we do? If my mother dies before this is paid off what will happen? Payment of the remaining balance is not the problem. Did we get bad advise?

To avoid probate she could transfer the home to a Living Trust now. The Estate Planning and Trusts and Wills section explains it. READ IT NOW.
