Can an attorney maintain an action against another party without a plaintiff or a proper party interest? --Land case involving an attorney filing a motion to dismiss a complaint and the plaintiff defended, was deceased six months prior to filing.

I'd have to know lots more -- but usually it is easy (and in some states automatic) to substitute the estate / executor / aministrator for a deceased party.
