What is the name of your state? New York

Wife seperated from me (not legal seperation) 3 months ago and I was served with Summons for divorce. I want to file my income tax as married filing seperately. Wife tells me that since we are in the process of a divorce I must get her attorneys approval to file that way otherwise I must file Married jointly.
Could this be true?

No, she's shining you on. You would not have to file with her even if you were still living together. If she wants to file jointly, she can bribe you into doing so.

BTW, if she has a divorce attorney, you need one too.
