What is the name of your state? New York

Wife seperated from me (not legal seperation) 3 months ago and served me with a summons for divorce. I want to file my income taxes as married filing seperately. She tells me that since we are in the process of a divorce I must get her attorneys approval to file that way otherwise I must file married filing jointly. Could this be true?
