help, my mother has my late father's funds!!!

my father passed away and left mutual funds that were put into my mother's name. unfortunately, she has had a drug problem in the past, and is incapable of taking care of a large sum of money. she also had a brain tumor 15 years ago and has never been the same. is there a way to get the funds transfered over to another name of a person that will use the money as a safe-keeping for my sister and i? even my name if need be?

If your father left her the money it is hers. If she is not mentally competent you could seek a conservator. See Elder Law on FreeAdvice.com

the money was not left directly to her... it was put into her name when he passed away. he left nothing to her directly, she just happened to be the only immediate family member that was over 18. otherwise the money would have been put in my name and now that i am 21, i feel that the funds should be transfered to me.

If the funds were to be held in trust for you, you have been entitled to them as soon as you turned 18 or 21. Ask your mother for them, or the bank that has custody -- it may appear in the original court records!
