ok where to start cause this situation is really messed up...
I am actually looking for advice to help my father inlaw. let me start here...He began purchasing a home and several acres of
land about 12 years ago.
About 2 years ago he remarried. One year after the marriage, final payment was made on his property. Soon after the last payment was made she she became abusive towards him, had him kicked him out of his own home and accused him of domestic violence against her which did not happen and managed to have him arrested with these false claims.
well the system being what it is took her word for it and arrested him even though she had no physical evidence on her yet he had evidence of her abus and witnesses to verify that she hit on him. After spending the weekend locked for the domestic violence claim my father in law returned to his home only to be served with a restaining order and police waiting to arrest him for being on "her" property. (let me remind you that this property was bought 12 years before they met and the final payment on the property was made just a month or so before this) During the weekend he was locked up she with help from a friend she went through his home and distroyed everything of his, my husbands and sister-in-law's childhood items, all titles to vehicals, the land, and the home that showed any proof of these things belonging to my father-in-law.
here is the real messed up thing. the parish he is in isnt known to be the most honest jurisdiction. he was denied any legal advice in the arrest from her claims saying because it was domestic he had no right to counsil and the judge sided with her believing her claims that everything was hers. She cleaned out their accounts leaving him without any funds and has managed to have him fired from his job and any job he has acquired sense then to prevent him from being able to pay for a lawyer. She has managed to convince the judge that she owns the property without any proof of such. Though the judge ordered that he take his vehicals and that they be removed asap. The condition due to the restraing order she managed to get is he had to have a police escort to get the vehicals and what was left of his belongings if any. With the judges order in hand the police refused to escort him to get his belongings saying it wasnt their problem. Well after fighting back and forth in court with this issue he did get a vehical through having someone other than him pick it up.
Ok he is to the point where yes he is crushed she took everything from him but wants this pshyco to leave him alone so he can get on with his life. She can have the land, his home everything. he just wants her to stop harassing him. He has not had any contact with her in months yet she is still making accusations and doing everything to ruin his life and bleed him dry. A couple days ago he recieved a notice to appear in court again. Apparently someone drove by his old home and stopped to ask about a parked car in the yard thinking it was for sale. (this is the vehical he was unable to get in fear of being arrested even though he has a order from the judge that oks him to get his vehical yadda yadda) She without stopping to find out what or who this person was, called the police again saying it was him and that he was going to kill her. Apparently she did speak to these people after and told them to go to my father in law for information on the car which they did contact him which is how we found out about this claim, Even after seeing it wasnt him she still insisted to the police who came shortly after that it was my father in law and to go arrest him showing a restraining order. Ok so now he has to go back to court and if she is able to convice the court yet again of her lies which she has managed to do over and over he could face 5 years. Now my father in law is a good man and does not deserve any of this treatment. We really feel this woman is pulling a scam cause nothing of this sort happened until he paid the property off then she took everything including the shirt off his back. They are still legally married, he wants a divorce and wants her out of his life. She has not filed and is preventing him from being able to afford to hire a lawyer to get a divorce or to protect himself from her futher alligations.
Today he got a phone call from one of his former neighbor who has seen this all develop warning him that she called the police again today claiming he was there because she found a can in the front yard claiming the can was proof he was there to kill her. Is that crazy or what!! The neighbor said the police laughed at her as though she was crazy and left. I wanna know how much she will be allowed to get away with before they realize she is crazy or a crook. Anyway I am looking for advice to help with his situation. He really needs a lawyer badly before she does something to really distroy his life further. So far any help he has tried getting has been shot down and when arrested from her previous alligations was told he didnt have rights to a court appointed attorney cause it was domestic.
