What is the name of your state? CA

My brother is a foreign student. He came to US for his master degree study in August 2002. Can I claim him as a dependent on my tax returns?

If he meets the 5 dependency tests and is a resident of the US, Mexico, or Canada at some time during 2002, you can claim him. However, if he's here on a student visa (F, J, etc), the first 5 calendar years he's in the country on the visa are *not* considered years of residency. He would not be a US resident during 2002 & you could not claim him.
