Need to set aside settlement agreement

What is the name of your state? Ohio
I am going through a divorce. My estranged husband and I signed a Settlement Agreement. Since then, my estranged husband abducted me and our two youngest children at knife point and told me that he will kill me and the kids if I go through with the divorce. He is currently in jail on three counts of abduction and one count of resisting arrest.

My divorce is set for a final merits hearing this Wednesday, March 19, 2003. I need to know if I set aside the settlement agreement, will I have to wait until my estranged husband is convicted to get my divorce or can I simply retype the decree?
