I was arrested on November 18th of 2002...Charged with meth
residue that they claim was on a shop towel..
When the cops field tested it they told me it showed positive for meth...Well I knew they were wrong because I don't do meth..
But at any rate my attorney told me not to worry because they
would have to send the evidence to the crime lab, and their tests
are more accurate...
However, I just found out yesterday March 17th of 2003 4 months
later that the evidence was just sent into the crime lab on
March 14th...What I would like to know is if the police department
can wait that long before sending it to the lab????And the only reason they did send it on the 14th is because the prosecutor
called them and told them to get it sent in...Is there not some kind
of policy or procedure that these cops need to follow????

Haven't you seen people cleared on DNA charges YEARS after the crime is committed and evidence taken? I would believe that as long as the chain of custody is intact and it isn't long enough to degrade (years for drugs), there should be no problem. You don't do meth...is this towel gonna test positive? Why did they test it in the first place?
