What is the name of your state? new york
my house, purchased after marraige, is in my husband's name only because i was forced to file bankruptcy. i pay half the mortgage. i want half the equitable amount. if i move out is that considered abandonment and do i forfeit my rights to half the house?

If the property was purchased after you married, it doesn't matter who's name it is in.... you are both entitled to half.

As far as abandonement.... I don't think this would have anything to do with how much you are entitled to out of the house. But do check... I'm no lawyer.

Where I would really be concerned with abandonement is if you have kids, and you take off and leave them behind... that's not so good.

But if it is just you and your hubby, and things have come to the end, what recourse have you BUT to move out if he won't? I don't believe anyone would expect you to live with him until the divorce is over.
