My brother and sister in law were divorced approx. 4 yrs ago. He was awarded sole physical custody with joint legal. She has a history of manic depression and suicide attempts (while home alone with the minor children). My nephews are 7yrs old and 5 yrs old, as of 7/2000. In the unfortunate event that something happens to my brother, would my nephews go straight to my ex sister in law, even with her history?? Is there anything that our family could do to prevent it?? If so, what are some suggestions of things that would need to be done?? Anything that should be done now, before anything does happen?? Thank you. I am hoping that this is the right board to post this on.

He can write a will, nominating someone else, and describing the reasons in a separate document. It ultimately would got to the judge to decide, and the stronger the case that is established, the more likely custody would be given to aperson other than the mother.
