Recently my dad was named the sole individual inheriting his brother's estate. My dad's other brother has now come to him after the will has been probated and told him he is going to sue my dad for some of the inheritance. His claim is that their brother was not of sound mind when the will was made up. This is taking place in Texas. Nothing was ever filed while the will was in probate court. Can he sue my dad just because he was not named in the will or can he contest the will now after it has already been probated? If he can contest the will now how long does he have to do so?

You should really consult with a Texas attorney. Usually, a probate petition is submitted to the court. Then the court will notify certain family members (distributees). Your dad's brother should have been part of this group notified by the your dad's brother is too late to make any sort Court. The Court then gives these notified family members a chance to come forward and contest the proceedings. This incompetent and did not have the capacity to execute the will.would have been your dad's brother's opportunity to say the decedent was
