Hello, I am trying to find out how an executor is legally appointed. Is the person just named as executor in the will or do any legal papers need to be prepared and signed? I was asked to be a "backup" executor and I cannot ask the person directly.

My response:

If a person is named in a Will to perform the duties of Executor, upon filing for Probate of the Will, that person will be confirmed (if that person meets the legal requirements).

If no one is named, any relative can file for Probate of the Will, and the court will appoint an Administrator of the Will.
