Would somebody please tell me how in the heck to make up the ownership on the annuities, so, that it won't be probated???? Over half of ours has to be probated because my deceased husband is on them as "owner". They are in a Trust!!!! Not a bit of protection there..what misinformation is "sold" to a client, when you put your faith in an expert!!!

Annuities pass according to the beneficary form that is executed by the owner of the annuity. Unless you put your estate as the beneficiary, the death benefit passes by operation of law to the designated beneficiary outside of the probate process.
(Of course, the date of death value of the annuity is still in the decedent's taxable estate subject to estate taxes if any are due)
