My question is whether the military stop loss policy is constitutional and whether it follows contractual law?
Currently, once your enlistment contract expires, the military can keep you in service for an additional year if your "military job" is one effected by the stop loss policy or in the case of deployment, you are required to remain with your mobilized unit through the entire deployment plus de-mobilization plus an additional 90 days (this could be in excess of 3 additional years in particular cases). I reviewed the related enlistment contracts and noted no statements what-so-ever that allows the term of service to be extended past the contract expiration date. Please advise?
