What is the name of your state? california

when a person is relesed from jail signing a notice to appear pursuant to 853.6 pc but when they arrive at appointed court date no charges had been filed. Then their asked to return on another date that would make it 90 days from date of arrest, wouldn't I then rely on pc 853.6(e)(3) which in turns says the prosecution has 25 days in which to file. My consitutional rights to a speedy trail too. And Doesn't federal law supersedes state?
