My father passed away without a will this year. He was disabled and had to take a total distribution of his 401k last year. When preparing his 2002 taxes, his tax liability came to $60K. My mother has not worked in many years, but they always filed married/joint. We were advised that if we file his return married/separately, no one would be responsible for the taxes. Is there any truth to this? There was not much money left in their joint cking account and my mother was the sole beneficiary of his life insurance. Is any of this money subject to levy for the taxes?
