What is the name of your state? Florida My fiance was hit with the Additional Alternative Min. Tax of 1997. He doesn't meet any of the qualifications. He was in Desert Storm and had a friend of his mothers do his taxes. During this time his copy of his return was lost in a fire at his mothers. He recev'd a refund that year for approx. $600. When he was notified of the additional tax and penalty owed it was approx. $7000. Needless to say not much has been done to resolve this matter because the tax preparer is no where to be found, and the information he requested from IRS has never been received. A printout was sent but not an actual copy of his return including his itemizing stmnts in order for him to see actually what the preparer had done. He was sent a letter that stated something like "just give us almost any reason that he feels IRS didn't comply with any of his request and the file will be closed." Unfortunantly he can't find it. He consistantly recieves letters with the accruing penalty and interest amounts increasing, now totaling approx. $24,000. Also, he was told from IRS that he recv'd another check that year which he states he knew nothing about. He asked if it was cashed, they replied yes so he then requested a copy. Still hasn't recieved copy of check. He also has a lien on his 401 K which is the money he was planning to use for a Tax Atty. He can't touch it without IRS taking it all. He;s a father of two toddlers who had been laid off for a while and really needs the financial help of his 401 K. Please advise what he should do and if he really needs an Atty.
