A couple of employees of public agency had the spouse of an employee purchase the academic version of a software program from the local university bookstore (which is an educational reseller and is only allowed to sell the software for student use ) under the false representation that the purchase was for the spouse's (purchaser) use for educational activities. In reality the purchase was for departmental use, which violates the license agreement; and the software has been installed so it can't be returned.
The difference in price is approximately $1000
My questions/concerns are:
1. Is was a crime or merely a civil matter? (since there was intentional deception invovled)
3. Given the difference in price is it a misdemeanor or a felony (assuming it is criminal)
3. Does it matter if the expense was recovered using federal
grant funds?
