Terminating a parents rights in Massachusetts

Does anyone know if there is a law regarding parental abandonment in Massachusetts? My sons biological dad has not seen him or had any contact whatsoever in 4 years. I am now remarried with a new baby and my husband wants to adopt my older son. My son has no recollection of his biological dad, as the last time his father saw him he was only 5 months old. My husband has been in my sons life since he was 12 months old, so this is the man he considers "daddy". I dont know where my ex is at this time, do I need to locate him to terminate his rights? And does he have to voluntarily sign over his rights even after all this time of no contact? Everything I have read points to the fact that he does,but I guess Im just hoping to find something else. Every state has a law of abandonment of a child. 4 years with no contact & no support is definitely more than enough time to file for termination of his parental rights.

I suggest you have a consultation with a good family attorney and have your husband file a petition to adopt, with your consent.

Stepparent adoption laws are made exactly for situations like yours. You have a classic case and you should succeed with no problems, as long as your husband can pass a background check.

The court will do whatever is in the best interest of the child!
