We recently got custody of my stepdaughter age 11. She's been through alot in the last 6 years and now she's with us. She doesn't want to go to her moms on the specified times in the custody papers. Does she have any rights? Is there an age limit when kids can decided if they want to go visit or not. Any advice would be greatly appreciated. Thank you Tammy

The basic idea is that the rights to child custody and or child visitation is for the child and the parent. However, it is the parent that is awarded custody/visitation. That award is based on a number of things, which added together are hopefully in the best interests of the child. So the bottom line is that you have to make the daughter available to the other parent on the dates specified. After awhile the other parent won't bother because of the mess and hassle. Also, to just cut this process short, you can go back to court to reqeuest that the visitation be changed.
