As of right now I am going through a year long divorce. The funny thing is there are no children involved and no big assets or debts. I got married on Dec. 12 1998 and started my divorce the begging of Mar. 1999. I got married in an Il courthouse and went to Italy on Dec. 28 1998 for work related reasons (USAF). My lawyer represented my husband in a court case a few years ago and I was unaware of it so I hired her as my lawyer. Now I am getting screwed over royally. What do I do now when my lawyer is defending my husband more than me and trying to get me to pay alot of my husbands debts?

1) Fire your lawyer immediately.

2) File a complaint with the IL state bar disciplinary committee. File a copy with the divorce court. Tell them that your divorce lawyer represented your husband on another matter in the past, did not disclose this fact to you or give you a chance to consult other counsel, and now appears to be trying to protect his interests at the expense of your own. This is a violation of Rule of Professional Conduct 1.8 (I think that's the number) on conflicts of interest.

Ask that the bar discipline her AND ask that they force her to return your fee. That'll get her! Nothing wakes up lawyers faster than threatening ot take their fees away! BWAAHAAAHAAAHAAA!!


Seriously though, lawyers get suspended for that kind of behavior.
