We own a small business and our building was flooded a month ago. We had SEVERAL items get damaged and had to close for a week because of all the mess. Our landlord refused to call us or come by to see the damage. The roof was being worked on at that time........they had worked on it the week prior for one day only and then left it. The store owners next door to us were told by the roofing company that the tarp would hold and then they would finish it later. A storm came through and when that happened the roof leaked EVERYWHERE. Not only in our store but the other store too.

We contacted the roofing company because we felt it was negligence on their part since they left it in disarray for over a week knowing that if it rained what would happen. The owner of the roofing came in and offered to write a check out for the damaged items because he did not want to go through his insurance company. HOWEVER when he got there he only wrote one out for PART of the items damaged. He told us that he would come back that afternoon with the rest but he didn't. He did take the merchandise that was damaged with him......not only the items that he did cover but the items he did NOT pay for but said he would. That was a month ago. To this day we have not seen a check from him. We have since moved into a new building but we have written him several letters who he has now gotten an attorney and had write us back. His attorney is saying that we are attempting to defraud his client! Which is NOT true. The amount in question is under $500 and if we were trying to defraud someone wouldn't we ask for more money?! We contacted his insurance company since we know the owner well. He said that he wasn't aware of any incident. Luckily for us we had witnesses and one of them happened to be the ins company owners son. ;) Plus we took pictures. ;) Anyway.....after he saw the pictures and talked to his son he was shocked and upset that this person didn't file a claim. Anyway......to go on with the story.

A friend of ours mentioned to us about filing a police report and charging this guy with theft by deception. Our question to you is can we do that after a time period of a month? :confused:

I personally would love nothing more than to just forget this whole incident because things are going so well for us now at our new location but my husband thinks we need to go after this guy. Now the other store next to us came by and told us that they had an excess of $50,000 damage!! The roofers and the landlord are ignoring the calls and letters from them too. They want to bring forth a lawsuit.

What do you think we should do? :confused: A friend of ours works in a attorney's office and she told us that with such a small amount it may not be worth the stress and frustration to pursue it even though we are in the right. Especially since this company is wealthy and has been known to throw around $$ when they need something.
