NY, Kicking out drunken father?

I just turned 18 a month ago. My family is trying to figure out how to kick out our father from our house legaly. He dosn't work. He drinks execivily and even stinks rotten. He has a history of domestic violance.

My mom works 3 jobs to pay for everything while he just takes advantage.

Who's name(s) is/are on the property or lease?? If his is on it, then he has rights to access. The only way to force the issue would be for her to get a TRO and file for divorce.
