What is the name of your state? Tennessee
A friend of mine and his soon to be ex-wife are going through a divorce. At first, it was uncontested, but now she wants him back and refuses to give him a divorce. She cheated on him, moved into a new house with the guy, and they already signed papers. The divorce won't be final for 3 weeks because they have children, and had a 90 day period before its final. She went to his house yesterday, held a gun to her head, and had to be taken to the hospital for an evaluation. As the Police were escorting her to the patrol car, she told him she wasn't giving him a divorce. Can this divorce still be granted, and what does he need to do to get his divorce? Thank you for any help. I looked at a lot of posts, and didn't see a situation like this.

~~~If she is contesting the divorce...your friend may have to have grounds for a divorce. If he can prove she committed adultery, and moved in with someone else while still married, than he can use that as a ground for a divorce. Malicious desertion or absence of either party without a reasonable cause for one year is another ground for a divorce in Tennessee. If your friend could get a copy of the police report stating she put a gun to her head and was brought to the hospital for evaluation...that may also be a ground for a divorce. Which may also be referred to in the pleadings as inappropriate marital conduct. He should speak with his lawyer about this.
