When my fiance and his ex- wife filed for divorce, in the papers was stated that she would keep a car that was under his name but she agreed she would keep paying the payments. Well she returned the car with 3 months behind in payments and eventually he could not pay two car payments and the car was reposessed. Can he take her to court and have her sued to pay what they are now asking for him to pay...Fees and so forth a total of $3,000?

*A- This sounds like an agreement between the two parties and not a court ordered judgement of distribution of property. This agreement does not override the terms of the contract that your fiance signed accepting sole liability for timely payments on the automobile. The smart thing to do would have been to refinance the vehicle with her as a cosigner so that if the loan defaults, the bank goes after her. He took a big risk and lost.
