What is the name of your state? CA and VA.

How does a couple go about getting a divorce, both are in agreement, no property to split up. The only problem is that the husband sent $800 to the wife, who said that's what she needed to get the divorce done. The she spent it on other stuff.
He wants to know if he can take care of it himself? And without a lawyer? He's in VA, ahe's in CA.
He doesn't even know how to start the process.

First, write off the $800. It's gone. However, use the loss of the $800 as a lesson that he needs to hire a lawyer. That example alone shows me that she cannot be trusted. Next, he should file for divorce in his state of residence. She will subsequently be served the papers in her state. In VA (a no fault state) parties who have no children can get divorced after they have lived separate and apart for one year, unless they have a written separation agreement, which would then shorten it to six months. The period of separation, whether six months or one year, must be continuous, without interruption and without cohabitation. If there are no further issues, it's a matter of signing the paperwork in the presence of a notary and finalizing it with the court (the parties need not be present).
