Our attorney claims that challenges to my mother in law's living trust are to be paid from the proceeds of the estate rather than from the pockets of the challengers. Is this true? and doesn't this encourage malicious challenges with no basis?

My mother in laws trust was drawn up by the same attorney, and specifies that her entire estate go to my wife, who is an only child. Our only challenges would come from a half brother who has an older will that was signed without an attorney, and under duress.
