What is the name of your state? Texas

If a subcontractor on a house we are building has abandoned the job with $5000 paid to him for materials and labor (he worked 4 days of a 3 week job and did not furnish the material as per his quote), what is the best avenue to pursue to get our money back? We have info from the check he cashed. is small claims court the best process or is there someother way to go?

If this is actually a SUB-contractor, your best approach would be to go after the contractor that got your money.... then let him go after his 'sub' if he needs.

However, it is important to first determine if the defendant has any assets to go after before proceeding with litigation. You might also consider contacting the local police and seeing if they will accept a charge of fraud or theft against the contractor.
