Question.

In my wifes divorce settlement 4 years ago, she agreed her ex could have the house which was still being paid on with no financial settlement. This is written in the Decree. Now, her name still remains on the property deed and loan. Is she obligated, due to decree, to sign ness documents when her ex refinances to remove her name from deed ? They agreed on a "no fault" divorce and things were much calmer then, but have become much strained due to their childrens troubles and his lack of responsibility involving them. Thanks.

I can't believe your wife didn't INSIST on being removed from the deed and mortgage...

If it's not written that she will "sign all necessary documents when called upon" she can refuse and he can bring her back to court and you guys can incur a bunch of nonsense legal fees in the process. He could ALSO decide to play the bitter game along with y'all and just stop paying the mortgage - and wreck your wife's credit in the process...

Some advice...sign the papers with a quickness and get your wife's name OFF of the mortgage and deed. If she' not entitled to anything out of the house then what is the problem?

Yes or find herself possibly in contempt of the court order and if that is the case, be responsible for his lawyers fees/court fees and sanctions as well. Property was has been decided. If she is having problems with the ex concerning the children then she needs to file the right motions for the judge to consider. Most of them can be found HERE:
