What is the name of your state? New York

Where can I find if a person left a will and whether it was ever probated. If it wasn't if that person had an estate and who his
heirs at law and distributees were.

Would this information be available to anyone using the Freedom of Information Act? Must one be a relative to obtain a copy of the will? Thanks

A will is normally filed in the courthouse in the county the decedant was residing in at the time of his death.

Specifically in the probate court. Usually you can call and they will forward you a copy of the file for a fee. It helps to have a copy of the obituary when you call.

Do you live in the same county as to where the decedent died? If so, then you can go to the county courthouse yourself and look at the probate file--it is available to anyone who asks.
