What is the name of your state? NY
According to the NY law , when one spouse die, how much from the estate, the children receive and how much the other spouse.Thanks for your answer.

I am assuming that there is no will. If that is the case the spouse is entitled to fifty thousand dollars and one half of everything else. The remainder is split between the children.

Any property or bank accounts held jointly are not a part of the estate and go directly to the spouse.
