The person that was going to put our roof on told us he needed the money to buy the materials. We gave him money for the materials and we going to pay him for putting the roof on after the job was done. As he began working we quickly found out that he had no idea what he was doing. We also found out that he told us the materials cost almost half the price that he told us that they did. Because of the shotty work and him refusing to give us a copy of the materials that we bought we told him that we did not want him to finish our roof. We asked him to return the portion of the money that was not used to buy materials. He did not so we are going to small claims court. He said he is going to counter sue and is going to put a mechanic's lien on our house.
We never signed any contract with him and even two days before he was going to start would not confirm a price to do the work. He did not want to commit because he thought he could get more if we got more from our insurance company.

Need some advice as to whether we are doing the right thing in going to court or if we will be paying him more money because he didn't do anything wrong legally. ??????
