What is the name of your state? Illinois

I bought a laptop on e-bay and it arrived DOA! The seller refuses to return e-mails or phone calls. I can't afford to throw away $400 so I am considering small claims court. Problem is that the seller lives in New York. Can a small claims case be filed accross state lines?

My response:

That's the problem when you buy things across State lines. The jurisdictional problems cost more than the amount of loss. In this case, if you want your "pound of flesh", you're going to have to file in New York and spend the nonreimburseable travel expenses to exercise your rights.

Most sellers know this is both a logistical problem and monetary problem for buyers. This is why most of these scammers get away with their cheating.
