non compete between partners

I just sold my business to my old patner. In the sale he put a non compete ( 10 miles and/or in the same county). My question is I would like to open the same business again and I am not sure that if I open with in those limits there is anything he could do? What is the worst case?

Worst case is he sues you, wins, you pay damages and are forced to close down your business and are out all your investment.
