I am the defendant in a land dispute that was resolved with an oral/written agreement prior to court. The terms were that I survey the property and pay the plaintiff a set amount within 1 year. Over the year, the plaintiff has breached the agreement 2x with police reports filed. During tis time, my attorney has several conversations with the plaintiffs attorney; one conversation, plaintiff attorney stated they didn't agreement with survey, knew his client moved visible surveyors stakes and intended to file paperwork to that effect. The year expired without the payment and I just received a notice to enforce with statements that I personally moved survey pins (a felonious act). Questions: can the plaintiffs attorneys statements be used against them to show any type of intent or conspiracy to violate the agreement and is the attorneys written statement in the filing a form of libel?
