I have a judgment against an ex girlfriend (Wendy) for $1300. We went to court today for a Proceedings Supplemental. We didn’t go before the Judge. We only spoke to a court clerk. The clerk asked Wendy about her employment and income. Wendy told the clerk that she didn’t owe me the money and she wasn’t going to pay me anything. The clerk asked Wendy again about her employment and income. Wendy said she is a stay at home mom and the only income she has is the child support for her children. The clerk asked me what I wanted to do. I asked about Wendy and her husband’s construction business. The clerk said that Wendy’s husband’s business and income are irrelevant because I sued her not him. I requested that the courts issue a Writ of Execution on her property and freeze her assets. The clerk said I would have to hire an attorney to file the paperwork to do that. I asked to see the Judge. The clerk said we weren’t scheduled to go before the Judge today and that we were done.

Any suggestions as to what I should do next?

Can I file for a Writ of Execution on her property myself, or do I have to hire a attorney?

How do I find out about her bank accounts, and how do I put a freeze on them?

Any help would be greatly appreciated!

*** You can do this yourself.

*** You should have asked the questions about bank accounts and a LOT more at the time you had the debtor in for the exam.

Some things you can consider:
- Filing a judgment lien.
- Ask the court to issue a Writ of Execution. In Indiana, this is started by asking to sign the "Execution book".
