In a civil complaint, Superior Court the date the complaint is filed is shown on line at your site as the actual date the clerk filed the document. These documents don't wait on someone's desk for 2 months prior to getting entered. They are done in a timely manner, and the date reflected on line is the actual date the document was filed by the clerk.

Also, after filing, how long does a defendant have to respond to the complaint. I'm not sure if it is 40 days.

If an extension is requested by the defendant to file a response, this is granted by a court officer or judge. It is not simply a case of calling the opposing counsel and asking for a few more days. This would throw the system into disarray I would think.
