What is the name of your state? Tennessee
Two questions regarding libel/slander/defamation.
1. Can statements made about a person in legal pleadings (Answer/Counterclaim, etc.) be considered as libel/slander/defamation? Or are these documents considered privileged against such claims?
2. If a third-party (e.g. the press) were to publish a portion of the aforementioned pleadings about such a person, can that be considered libel/slander/defamation? If so, who would be liable for that -- the party who filed the pleading, the press, or both?
