Is Property I had before marriage joint property? Most is just personal. He only wants it to hurt me. It is things like photos of my mom. things my kids had when they were little. Kids are from fromer marriage. I am Ill now with no way of support.And he take advanage of this. because he knows I cant get a Att. Please can someone give me some advice as what my rights are.

Since there has been no legal action yet and the house is still in my name also can I get in trouble for going in when he is gone and taken my things. and what about marrible property?

Is it in both your names or just yours ?.

It is a tough question. When was the last time you lived in the property ? Assuming he has not changed the locks... then if it were me, I would go in and pack my stuff. Providing you do not take everything, there will be little he can do..

I last live there in june. I dont think he has changed the locks. and the house is in my name with him as cosigner. I left because abuse that I have documented by police. he was also fired from his job for abuse to elderly He is a nursing asst. Will that help me in court that not only he abused me but has been conviced of abuse to elderly?

If there is documented proof of abuse, get a restraining order placed on him. You can get this done at the local court house. Have the police serve it to him and request that he leaves (actually the police should escort him out of the house with just his cloths on his back). You should then be able to move back into the house and of course, change the locks.
