Hello, I would like to know if there is a statute of limitations on filing or taking the default in an uncontested divorce filed in California approx. 2 yrs. ago. There was an issue that the process server served the original summons on my ex-husband and did not return it,so the court would not let me file the default. Now there is a form that deals with such things (just release in July 2000) and I would like to know if I can proceed, or if I have to start the proceedings all over again. Can you help me?
