What is the name of your state? NY State


Could a subpoena be issued for the phone records of the cellphone that does not exist?

The person that I need to subpoena had changed their cellphone #. Could I still get a record of the phone calls even though the phone is not in service anymore?

Also, how bad of a crime could it be to be able to subpoena the records

You are treading into waters that require the services of a professional. I would suggest talking to a local attorney. And if you are a victim of a crime and the records were vital for prosecution, the DA's office will obtain all necessary subpeonas. You wouldn't have to do anything. If the police are not involved, maybe they should be.
