I just received a summons that says I am being sued for defaulting on my car payments. It says I need to respond within 30 days, but with what form? Also, do I stand a chance of winning? I bought the vehicle for my ex-fiancee who gave the vehicle to his brother last year and he is who defaulted on the payments. When I was contacted by someone about repossession of the vehicle I asked if I could catch up on the payments and he said no because in the state of California when you are 3 months behind the vehicle is automatically repossessed and you cannot make up the payments. Is this the law in California?
