The statute of limitations in California was 6 years for such crimes. If the defendant is out of the state, this can be extended for however long he is out of the state, up to 3 years. Also, if the time limitation hadn't run out before January 1st, 2001, the time limitation jumps to 10 years if there is clear and convincing evidence of such crime. Such evidence is very difficult to come up with from 7 years ago.
