I bought a car on July 21, 2003 and was asked to put a down payment of $300, I told the salesman that I am a single mom and on ssi disability and have a job too, but I still couldn't afford the down payment until August 21, 2003, the salesman told his manager and they both agreed that I could write a post dated check for the down payment and they would hold the check until August 21, 2003, but needless to say they (the manager and the dealership) sent the check in on August 12, 2003 not August 21, 2003 like we all agreed upon, so when my I went to my bank to deposit some money one day and they told me I was overdrawn, so I asked them (the bank) to give a printout which they did, and at that time I realize the post dated was sent in early. At the time of the paper signing I asked the manager if I needed to put the post dated date in the place where the date goes on the check, but he told me NO, that the accounting office would know to hold it for 30 days, and he was going to tell them again to make sure the check was held for 30 days, but the dealership only held the check for 20 days, when asked about this they informed me that they had told me they would hold the check for 20 days and if I needed them to hold it for 30 days I was to call them and let them know, but I remember just the opposite and so does my boyfriend who was there for everything including looking for the car that was right for me and signing the papers and all the negotiations because I trust his judgement and because also he is a man and I heard cases where car salesman try to pull the wool over a woman's eye, so I had him to go with me every time I had to deal with these people. Needless to say that the check cause my account to have a lot of nsf charges about $900 worth, just for a $300 check, but my September SSI check covered about $500 of the charges and the bank told me not to worry about the rest of it because it would be wrote off and not charged to me, well I receive a letter in the mail the other day from a collection agency who will sue me if I don't come up with the other $431.00 and some odd cents to pay off the rest of the nsf charges, also I traded in a ford escort that was not running and a ford pick up which I deliver to them on the day of sale for my new/used car, the agreement was for the dealership to have a wrecker pick up the escort the following Monday which would have been the 28th of July, I believe, but the dealership didn't pick up the car until October 2003, at which time I informed them I was going to charge them storage fees for them keeping the car in my yard for so long, the manager at the dealership just laugh when he received the registered letter and told me they were not liable for the fees not the nsf charges that were on my account for they have done exactly as they said they would, now I know personally of several friends and people that I have talk to while I was at some businesses and they all told me the same thing have happen to them and that the car dealership was famous for that kind of stunt and that I should had gone to another one instead of them. My question is " what can I do about this"???? if anything. Thank you for your time and consideration in this matter.

*** Simply, there is nothing you can do. And though your post describes several 'miscommunications' and maybe even wrong-doing on their part, everything is verbal. And without some support for your claims, any legal process will very likely be unsuccessful. I suggest you learn from this and get EVERYTHING in writing in the future.
