I am executor for a relative's estate. The relative left his stocks to be put into a trust for his grandchildren. These made up over half of the estate. The estate attorney told me that calculation of the executor's fee cannot include the value of those stocks. It does not make sense to me. I had to find the stock certificates, inventory them, and turn them over to the lawyer, whose attorney's fees will be calculated using the value of the stocks. Is this correct? I have questioned this attorney's statements in other cases and he has backed down. Where can I see a ruling or citation relevant to this issue?
